1. Service description

PingPrompt is an early-stage product that provides tools for prompt design, testing and analysis. The Service is offered on a best-effort basis and may change, be interrupted, or discontinued at any time.

2. Eligibility and account

You must be at least 18 years old and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

3. Acceptable use

You agree not to misuse the Service, including by:

• violating applicable laws or regulations (including LGPD and GDPR);
• attempting to gain unauthorized access to systems or data;
• abusing, harassing, or harming other users;
• sending spam or automated messages at scale; or
• reverse engineering or circumventing security or usage limits.

4. User content

You are responsible for the prompts, files, and any other content you submit through the Service ("User Content"). You retain ownership of your User Content. By using the Service, you grant PingPrompt a limited license to process and store your User Content solely to operate, maintain and improve the Service.

You must ensure that you have all necessary rights and legal basis to process personal data in your User Content under applicable data protection laws, including the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados — LGPD).

5. Data protection

PingPrompt acts primarily as a processor of data on your behalf. We process personal data in accordance with our Privacy Policy and with applicable legislation, including LGPD, to the extent it applies. You remain responsible for configuring the Service and using it in a way that complies with your own obligations as controller of the personal data you upload or generate.

6. Third-party services and models

The Service may integrate with third-party APIs, AI models, or cloud providers. Those services are operated by independent entities and are governed by their own terms and privacy policies. We are not responsible for their availability, performance, or handling of data.

7. Intellectual property

PingPrompt and its associated branding, documentation, and software are protected by copyright and other intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

8. Beta disclaimer

The Service is provided as an Beta version and may contain bugs, limitations or incomplete features. It is offered on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

9. Limitation of liability

To the maximum extent permitted by law, PingPrompt will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits, revenues, data or business opportunities arising from or related to your use of the Service.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms or misuse the Service.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the date on this page or through the Service. Your continued use after the changes take effect constitutes acceptance of the updated Terms.
